 PART I PRELIMINARY

  Ordinance may be cited as the Protection of Wages on 
Insolvency
  nance.
  nterpretation
  his Ordinance, unless the context otherwise requires--
  licant" means any person who would, on the winding up of a company,

 PART II PROTECTION OF WAGES ON INSOLVENCY FUND BOARD
  
  stablishment and incorporation of Wages on Insolvency Fund Board
  There is hereby established a board to be known as the Protection 
of
  s on Insolvency Fund Board and in the Chinese language as which 
shall
  body corporate.
  The Board shall consist of a Chairman appointed under the Schedule
and
  more than 10 members appointed by the Governor as follows--
  subject to paragraph (b) not more than 4 public officers;
  equal numbers of persons who, in his opinion, represent employers 
and
  ons who, in his opinion, represent employees.
  The Governor shall give notice of each appointment by notice in 
the
  tte.
  The Schedule shall have effect with respect to the Board.
  unctions and powers of the Board
  The Board shall have the following functions--
  to administer the Fund;
  to make recommendations to the Governor with respect to the 
rate of
  ; and
  to perform such other duties as are imposed or other powers as 
are
  erred on it by this Ordinance.
  The Board may do all such things as are necessary for, or 
incidental
  onducive to, the better carrying out of the functions of the Board
and
  in particular, but without prejudice to the generality 
of the
  going--
  hold, acquire or lease all kinds of property whether 
movable or
  vable;
  sell or otherwise dispose of all kinds of property whether movable 
or
  vable;
  subject to section 10, invest its funds in such manner and to 
such
  nt as it thinks necessary or expedient; and
  with the prior consent of the Financial Secretary, borrow 
money in
  manner and on such securities or terms as it thinks expedient.

 PART III FUND

  payments to applicants under section 16;
  expenses incurred by the Board for the purposes of this Ordinance;
  capital, interest and charges in respect of any loan; and
  any other sums required or permitted to be paid by the Fund under
this
  nance.
 PART IV FINANCIAL PROVISIONS
  
  inancial year and estimates
  The Board may, from time to time, with the prior approval 
of the
  rnor, fix a period to be the financial year of the Fund.
  In each financial year, before a date to be fixed by the Governor,
the
  d shall submit to the Governor, for his approval, estimates 
of the
  me and expenditure of the Fund for the next financial year:
  ided that the estimates for the first financial year of the Fund
shall
  ubmitted as soon as practicable after the commencement 
of this
  nance.
  The Governor shall consider the estimates submitted to 
him under
  ection (2) and may approve or reject them and, in the 
case of
  ction, may require the Board to resubmit the estimates 
modified in
  manner and within such time as the Governor may direct.
  The Board may, from time to time, vary the estimates approved 
under
  ection (3) and shall, as soon as practicable, deliver to the 
Governor
  atement in writing containing details of any variation.
  ank account
  Board shall open and maintain an account with a bank approved by 
the
  ncial Secretary and shall pay all moneys of the Fund 
into that
  unt.
  Investment of moneys
  moneys of the Fund that are not immediately required by the Board 
may
  
  deposited on fixed term or call deposit or in a savings account
in
  bank licensed under the Banking Ordinance (Cap. 155); or
  with the prior approval of the Financial Secretary, invested in 
such
  r investments as the Board thinks fit.
  Accounts
  Board shall--
  keep and maintain such accounts and records of all transactions
of the
  as the Director of Accounting Services may require; and
  after the end of each financial year cause to be prepared a 
statement
  he accounts of the Fund which shall include an income and 
expenditure
  unt and balance sheet and shall be signed by the Chairman.
  Auditors
  The Board shall at the commencement of each financial year 
appoint
  tors, who shall be entitled to have access to all books of 
account,
  hers and other records kept by the Board and to 
require such
  rmation and explanations as they may think fit.
  The auditors shall audit the statement of accounts prepared 
under
  ion 11 and shall report thereon to the Board.
  Statements and reports to be laid on table of Legislative Council
  The Board shall, within 6 months after the end of each financial 
year

allow,
  it to the Governor a report on the activities of the Board for 
that

  The Governor shall cause the reports and statements received 
by him

  Costs of administering the Fund
  All costs and expenses incurred by the Government in
administering the
  shall be a charge upon general revenue.
  The Financial Secretary may direct that a supervision fee 
to be
  rmined by him, in relation to such period as may be determined
by him,
  l be charged against the income of the Fund and shall at a 
time
  rmined by him be paid to him by the Board from the Fund and paid 
by
  into general revenue.
 PART V PAYMENT FROM THE FUND
  
  Entitlement to apply for ex gratia payment
  Subject to this Part, an applicant to whom--
  wages are due and unpaid;
  wages in lieu of notice are due and unpaid; or
  the liability to be paid a severance payment has arisen 
and the
  rance payment is unpaid, whether or not the severance payment is 
then
  may apply for an ex gratia payment from the Fund in respect of 
the
  s, wages in lieu of notice or the severance payment, as the case 
may

  An application under subsection (1) (in this Part called an

  No applicant shall apply for payment from the Fund in respect of 
any
  s for services rendered before 1 April 1985.
  No applicant shall apply for payment from the Fund in respect of
wages
  ieu of notice arising out of a contract of employment 
terminated
  re the commencement of the Protection of Wages on Insolvency

  No applicant shall apply for payment from the Fund in respect 
of a

before the
  encement of the Protection of Wages on Insolvency 
(Amendment)

  Payment
  Subject to subsections (1B) and (2) where it appears 
to the
  issioner that an employer has failed to pay any wages, wages in 
lieu
  otice or severance payment, as the case may be, or all or any of 
them
  n applicant and that--
  in the case of an employer who is not a company--
  a bankruptcy petition has been presented against him; or
  he has committed an act of bankruptcy within the meaning of
section 3
  he Bankruptcy Ordinance (Cap. 6) but a petition cannot be 
presented
  nst him by reason of section 6 (1) (a) of that Ordinance; or

  in the case of an employer who is a company, a winding-uppetition

  When the Commissioner makes a payment under subsection (1) (a)

  Where an application has been made in respect of a severance 
payment

Commissioner may

  The Commissioner shall not make any payment under subsection
(1)--
  to the applicant unless the applicant has verified his
application by
  atutory declaration in a form approved by the Commissioner;

  in respect of wages for services rendered more than 4 months prior

  Subsection (2) (e) (ii) shall not apply to wages in lieu of 
notice
  ing out of a contract of employment terminated before the
commencement

  Review by Board
  Any applicant aggrieved by any decision of the Commissioner 
under
  ion 16 may in writing--
  request the Commissioner to give reasons for that decision; and
  after being given reasons under paragraph  (a), 
request  the
  issioner to refer the application to the Board.
  Upon receiving a request from an applicant under subsection (1) 
(b),
  Commissioner shall forward all documents relating to the 
application
  he Chairman of the Board.
  The Board may confirm or vary any decision of the Commissioner 
on an
  ication referred to it under this section or may for those 
purposes
  ire the Commissioner to make further inquiries relating 
to the
  ication.
  Additional power of Commissioner
  Notwithstanding that in any particular case a petition referred
to in
  ion 16 (1) (a) (i) or (b) has not been presented against an 
employer,
  Commissioner may, subject to subsection (2) of that section, 
make an
  ratia payment under that section in that case if in his opinion--
  nded, 41 of 1988 s. 3)
  the employer employs less than 20 employees;
  sufficient evidence exists to support the presentation of a 
petition
  hat case on the ground--
  if the employer is a company, that he is unable to pay his debts;
or
  if the employer is a person other than a company, that 
he has
  itted an act of bankruptcy; and
  it is unreasonable or uneconomic to present a petition in that
case.
  Where the Commissioner exercises his discretion under 
subsection (1)
  ake payment, he shall give notice in the Gazette stating that,
in his
  ion, sufficient evidence exists to support the 
presentation of a
  tion on the ground--
  if the employer is a company, that he is unable to pay his debts;
or
  if the employer is a person other than a company, that 
he has
  itted an act of bankruptcy.
  Nothing in subsection (2) shall require the Commissioner to give 
more
  one notice in respect of each employer.
  No action shall lie against the Commissioner in respect of any 
notice
  n under subsection (2).
  
  Verification of application
  For the purpose of verifying any application under section 15, 
or if
  equired by the Board under section 17 (3), the Commissioner may

第一章 总 则
第一条 为加强市政公用基础设施管理,充分发挥市政公用基础设施功能,保障城市生产和人民生活的需要,根据有关法律、法规,制定本条例。
第二条 大连市市辖区、县(市)及建制镇内的市政公用基础设施,均依照本条例进行管理。
第三条 本条例适用以下市政公用基础设施:
市政设施:城市道路、桥涵、排水防洪设施、道路照明设施及其附属设施。
公用设施:城市自来水、燃气、集中供热管网及其附属设施。
城市电力、电讯、绿化设施管理按现行的法律、法规执行。
本条例适用范围以外的市政公用基础设施管理办法另行制定。
第四条 市城市建设管理局是本行政区内市政设施行政主管部门;
市公用事业管理局是本行政区内公用设施行政主管部门;
市建委集中供热办公室是本行政区内供热设施行政主管部门;
县(市)、区城建行政部门按现行体制的分工原则,行使市政公用设施管理的相应职能。
各级计委、建委、城乡规划、房地产、公安、环保等有关部门,应积极协同市政公用基础设施行政主管部门履行其职责。
第五条 市政公用基础设施建设,须依照城市总体规划,合理布局,配套发展。新建、改建、扩建市政公用基础设施工程项目,依照《大连市城市规划管理条例》第27条规定执行;要严格执行建设程序和质量标准;工程竣工后,提报竣工图纸和资料,经市政公用基础设施行政主管部
门组织验收合格后,方可投入使用。
市政公用设施管理,须建立完整的档案。
第六条 市政公用基础设施管理工作,应当贯彻统一管理、科学养护、积极改善、逐步提高的方针,保证市政公用基础设施的完好和正常运行。
第七条 市政公用基础设施是国家的公共财产,一切单位和个人都有依法使用市政公用基础设施的权利和保护市政公用基础设施的义务,并有权对违反本条例的行为进行检举和控告。
对维护和保护市政公用基础设施做出显著成绩的单位和个人,应给予表彰和奖励,对违反本条例的应依法予以追究。

第二章 道路设施管理
第八条 市政设施行政主管部门应当组织所属单位加强城市道路的维修、养护和路政管理,保证道路等级标准和安全畅通。
第九条 在城市道路上禁止下列行为:
(一)擅自占用道路;
(二)擅自挖掘道路;
(三)在铺装路面上进行有损路面的各种作业;
(四)擅自在非指定路段进行试刹车;
(五)机动车辆碾压道路边石;
(六)客货车在铺装的自行车专用道及人行道上行驶或停放;
(七)向路面排放腐蚀性污水;
(八)人行道上建永久性工厂、仓库、摊点(店)等。
第十条 临时建设、临时场地确需占用城市道路的,须持城市规划部门签发的临时建设工程规划许可证,经公安交通管理部门审批同意,到市政设施行政主管部门办理道路占用许可证,方可占用。
经批准临时占用城市道路的,应按规定向市政设施行政主管部门缴纳道路占用维修费。
第十一条 经批准占用道路的,不准擅自改变占用性质、扩大使用范围和延长使用时限,不准出租、转让。使用期满或在使用期内因城市建设需要时,占用单位和个人须将其在占用道路上的各种设施、物品等及时拆除和清理。
第十二条 城市道路挖掘应纳入年度计划,严格管理,开挖时间应控制在每年三月十五日至十一月十五日内。
城市一、二类道路,在新建、扩建后五年内、大修后三年内,不得挖掘。
在规定开挖道路的时限以外,因特殊情况确需挖掘的,经市政设施行政主管部门和公安交通管理部门审查同意后,报请人民政府批准。
新建、扩建、改建地下管线需要挖掘道路的单位,应于每年二月末前将本年度计划报市政设施行政主管部门统一安排。
建设单位在开工前,应持城市规划行政主管部门的批复文件、设计平面图和施工方案,经公安交通管理部门审批同意,向市政设施行政主管部门办理道路挖掘许可证件,缴纳道路挖掘修复费后,方可开工。
第十三条 自来水、燃气、供热、电力、电讯等部门因紧急抢修未能事先办理审批手续的,应在开挖道路的二十四小时内补办批准手续,补缴道路挖掘修复费。
第十四条 经批准挖掘道路的单位,应按批准的地域、范围、时间和要求进行施工;挖掘现场应设置护栏、标志等安全设施,确保现场安全;工程竣工时,应将回填土分层夯实,及时清理余土废料;挖掘形成的地下设施检查井盖应与路面保持平整。
挖掘道路工程竣工后,由市政设施行政主管部门组织验收,并及时组织修复路面;逾期未按要求修复的,应追究负责修复路面单位的责任。
第十五条 履带车和特殊超限运输车辆需要在城市道路上行驶时,应经市政设施行政主管部门和公安交通管理部门批准,并应采取必要的保护措施,方可按指定的时间、路线行车、停车。
第十六条 市政设施行政主管部门征收的道路占用维修费和道路挖掘修复费,应专户储存,专项用于城市道路设施维护和修复。

第三章 桥涵设施管理
第十七条 城市桥涵须严加保护,保证通行安全。市政设施行政主管部门应组织所属单位加强对桥涵的质量、安全监测,及时进行维修、养护。重点桥涵的质量鉴定和维修养护,应统一纳入城市建设计划。
第十八条 在城市桥涵设施及保护区范围内禁止下列行为:
(一)占用、损坏桥梁和隧道设施;
(二)在桥上、隧道内超车、停车、试刹车和摆摊设点;
(三)利用桥涵设施进行牵拉、吊装等施工作业;
(四)挖沙(土)、取石、修建妨碍桥涵设施正常使用和养护维修的建筑物、构筑物;
(五)进行危及桥涵安全的爆破性作业。
第十九条 车辆通过桥涵,须遵守限重、限高、限宽和限速规定。装载超重大件或易燃、易爆物品的车辆通过桥涵,应提前向市政设施行政主管部门、公安交通管理部门办理申报手续,并应采取安全防范措施,按批准部门的规定时限通过。
凡需跨越桥涵施工作业的,须经市政设施行政主管部门同意,并应保证桥涵安全。

第四章 排水防洪设施管理
第二十条 市政设施行政主管部门,要加强对城市排水防洪设施的管理,组织所属单位及时检查、维修和清淤排障,保证排水防洪管道、明沟、河道城市段、堤坝的完好、畅通。
新建企事业单位厂区院落跨越城市排水防洪设施的,应按市政设施行政主管部门的有关规定负责养护和疏通。
第二十一条 在排水防洪设施范围内禁止下列行为:
(一)破坏、堵塞或者擅自移动、占压排水防洪设施;
(二)排放腐蚀性物质、剧毒物质、易燃易爆性物质和易产生有害气体的污水;
(三)倾倒垃圾、废渣、施工废料和排放灰浆及其他杂物;
(四)修建妨碍排水妨洪设施功能发挥和安全的建筑物、构筑物;
(五)在河道城市段、明沟及其划定的管理范围内采掘沙石土、开荒种地或堆放物料。
第二十二条 向城市排水设施内排放污水的生产、经营单位,应按规定的标准向市政设施行政主管部门缴纳排水设施使用费。
排水设施使用费全部用于排水设施的养护维修、改造建设。
第二十三条 毗连城市排水防洪设施的建设工程,在施工时应当采取必要的措施,保护排水防洪设施不受损坏。建设工程施工需要迁移、改建排水防洪设施的,须经市政设施行政主管部门同意;迁移、改建排水防洪设施所需费用,由建设单位承担。
第二十四条 城市建筑物延伸的排水管户线同城市排水管线相联接的,须经市政设施行政主管部门批准和验收。排水管户线的建设、维修,由房屋产权单位负责。
第二十五条 有毒、有害,含有易燃、易爆物质的污水,须经自行处理,达到排入城市排水管道标准后方可排入。对于超过排放标准而损坏城市排水管道者,应向排水管道部门赔偿经济损失。

第五章 路灯设施管理
第二十六条 市政设施行政主管部门应组织所属单位加强对路灯设施的巡检、维护和停送电管理,及时组织排除故障,确保路灯照明设施的正常运行。
第二十七条 在城市路灯设施上禁止下列行为:
(一)擅自迁移、拆除路灯设施或使用路灯电源;
(二)依附路灯设施搭建构筑物,堆放、悬挂物品或利用路灯设施从事牵引作业,搭设通讯线路等;
(三)向路灯设施投掷物体、倾倒污物、乱贴乱画以及其他有损路灯设施安全的行为。
第二十八条 有关单位利用路灯电源,增设路灯设施,须经市政设施行政主管部门同意,并应按规定缴纳电费。
因建设施工等原因需要拆迁路灯设施的,应当由市政设施行政主管部门同意和组织拆迁,所发生的费用由申请单位承担。
第二十九条 利用路灯电源接线照明,须提前向市政设施行政主管部门申请批准,并应按规定缴纳电费。特殊情况来不及申请的,要在用电时起二十四小时内补办用电手续。
第三十条 因意外事故损坏路灯设施的,责任单位或个人在采取应急保护措施的同时,应当立即向市政设施行政主管部门报告。

第六章 燃气、自来水管网设施管理
第三十一条 公用设施行政主管部门应当组织所属单位认真做好燃气、自来水管网设施的日常检查、维修工作,确保燃气、自来水管网设施安全运行。
第三十二条 在城市燃气、自来水管网设施范围内禁止下列行为:
(一)损坏和擅自启动、改装、移动、拆除自来水、燃气管网及其附属设施;
(二)搭建棚厦、堆放物料、挖坑取土、种植树木;
(三)利用和依附管网设施拉绳挂物或牵拉作业;
(四)在燃气、自来水设施附近存放易燃、易爆物品;
(五)将燃气、自来水明管悬空或砌入建筑物和隔墙内。
第三十三条 需要新设、改设、拆除或迁移燃气、自来水管网设施的,须经公用设施行政主管部门批准;建设单位须遵守操作规程,按审定的图纸和技术规范要求施工,不准擅自变更工程设计。工程竣工后,提报竣工图纸和资料,由公用设施行政主管部门验收合格,方可供水、供气。


第三十四条 凡在燃气、自来水管网设施附近施工的单位和个人,须保护燃气、自来水管网设施不受损坏。因施工影响燃气、自来水管网设施正常运行的,须征得公用设施行政主管部门同意,并应采取相应的保护措施,按有关规定组织施工。
第三十五条 燃气、自来水用户有义务保护燃气、自来水管网设施,如发现有故障和漏气、漏水现象,应及时通知用户属地公用设施行政主管部门的站(所)。接到通知的站(所)应保证及时维修。
第三十六条 燃气、自来水用户应协助公用设施行政主管部门下属工作人员完成抄表、检修、施工等项任务。因拆装燃气、自来水管道需要通过邻户建筑物时,邻户应予以协助。

第七章 集中供热设施管理
第三十七条 城市供热工程建设,应当服从城市集中供热总体规划,在集中供热行政主管部门协调指导下进行。
需要新设、改设、拆除的供热设施,须经集中供热行政主管部门批准,建设单位应按施工图纸和技术规范要求施工,不得擅自变更工程设计,工程竣工后,由集中供热行政主管部门验收合格,方可供热。
第三十八条 城市供热行政主管部门须对供热单位进行资质审查,发放供热许可证。供热单位应积极采取新技术,加强对供热设施的检查和管理,及时组织检修、维护,科学调度,定期征求用户意见,按供热标准保证安全、均衡、稳定供热。
第三十九条 供热单位应在供暖期前,做好供热设施的检查、维修、燃料贮备和供热人员培训等准备工作,并于供暖期前三十天将供暖准备情况报告集中供热设施行政主管部门。
供热单位向企业、事业单位供热应实行合同制度,按年度、季度签订合同。
第四十条 禁止依托锅炉房和地上管网搭建构筑物、进行牵拉等承重作业;地下管网上方,禁止挖取土砂石和搭建构筑物等。
第四十一条 因施工影响供热设施正常运行的,须经集中供热设施行政主管部门同意,并采取相应的保护措施,按规定要求组织施工。
第四十二条 采暖用户要保护好供热设施,不得擅自改动管网及增挂暖气片,不得在供热设施上安装水嘴、淋浴器、排气阀等,不得排放供热管网的循环水。

第八章 罚 则
第四十三条 对违反本条例中有关市政公用基础设施管理规定的单位或个人,市政公用设施行政主管部门可依照管理职责,给予批评教育和责令停止违法行为、限期改正、赔偿经济损失。有下列行为的,可并处罚款:
(一)未经批准占用道路的或虽经批准但超过批准范围、时限占用道路、改变占用性质的以及出租、转让所占道路的,按道路占用维修费标准的五至十倍罚款。
(二)未经批准挖掘道路的或虽经批准但超过批准范围、时限挖掘道路,以及挖掘后未按规定回填沟槽的,按挖掘修复费标准的二至三倍罚款;在挖掘道路时未按规定设置护栏、标志等安全设施的,处五十元至一百元罚款。
(三)在铺装路面上进行电(气)焊、烧沥青和打砸硬物、拌和水泥沙浆等损坏路面作业的,处二十元至一百元罚款。
(四)机动车辆碾压道路边石、自行车专用道、方砖步道的,处二十元至五十元罚款。
(五)在道路、桥涵、排水防洪、自来水、燃气、供热设施保护范围内采掘沙石土、开荒种地、堆放物料的,处一百元至三百元罚款。
(六)履带车、超限车辆未按规定在道路、桥梁、隧道行驶的,处三百元至五百元罚款。
(七)利用市政公用基础设施装管布线和进行牵拉、吊装等施工作业的,处一百元至三百元罚款。
(八)擅自将排水管户线接入城市排水管线的,擅自在集中供热设施上安装水嘴、淋浴器、排气阀等设施的,处一百元至三百元罚款;擅自改动供热、燃气、自来水管网设施的,处五百元至一千元罚款;擅自使用路灯电源的,按应收电费的十倍处以罚款。
(九)向排水防洪河道城市段、沟渠、供热管道地沟内排放垃圾、废渣、施工废料、剧毒物质、灰浆、杂物的,处五十元至一百元罚款;向地下排水管道排放易燃易爆或具有腐蚀性物质的,处五百元至一千元罚款。
(十)因施工作业、肇事损坏市政公用基础设施或擅自迁移、拆除市政公用基础设施的,按造成直接经济损失的百分之十处以罚款。对擅自变更市政公用工程设计施工的,处一千元至五千元罚款;对市政公用工程未经验收而擅自使用的,处一千元至五千元罚款。
第四十四条 修建妨碍市政公用基础设施功能发挥和安全的建筑物、构筑物在限期内不自行拆除的,擅自堆放物资妨碍市政公用基础设施使用和养护、在限期内不清除的,市政府可责成有关行政主管部门强行拆除、清除。
第四十五条 自来水、燃气、供热单位,在正常情况下,未按规定检查、维修、养护设施,不按期供水、供气、供热,接到用户报修不及时修复,致使用户利益受损或造成经济损失的,应由供水、供气、供热单位负责赔偿用户损失,无理拒绝赔偿的,其行政主管部门或各级政府应予追
究,并可视情节对直接责任者处以政纪或经济的处罚。
第四十六条 对危及自来水、燃气、供热整体安全的用户,自来水、燃气、供热管理部门有权停止供水、供气、供热。
第四十七条 实施行政处罚,由处罚机关下达处罚决定书。实施罚款处罚,须使用财政部门统一印制的罚款票据,罚款全部上缴同级财政。
第四十八条 当事人对行政处罚不服的,可在接到处罚决定通知书之日起十五日内,向作出处罚决定机关的上一级行政机关申请行政复议;对复议决定不服的,可在接到复议决定书之日起十五日内,向人民法院起诉。当事人也可以在接到处罚通知书之日起十五日内直接向人民法院起诉
。逾期不申请复议、不起诉又不执行处罚决定的,由作出处罚决定的机关申请人民法院强制执行。
第四十九条 对破坏、盗窃市政公用基础设施,殴打执行公务的市政公用基础设施管理人员的,由公安机关依据《中华人民共和国治安管理处罚条例》的规定予以处罚;构成犯罪的,由司法机关依法追究刑事责任。
第五十条 市政公用基础设施管理人员滥用职权、玩忽职守、徇私舞弊的,由其所在单位或上级主管部门给予行政处分;构成犯罪的,由司法机关依法追究刑事责任。

第九章 附 则
第五十一条 大连市人民政府可依照本条例制定单项实施办法。
第五十二条 本条例应用中的具体问题由大连市人民政府负责解释。
第五十三条 本条例自1992年6月10日起施行。

为了正确贯彻出口退税政策,支持外贸发展,进一步加强出口退税管理,堵塞漏洞,保障出口退税工作的顺利进行,现根据国务院指示精神,经我们共同研究,特作如下通知:
一、加强出口退税计划管理
(一)出口退税实行与出口企业出口创汇任务、上缴中央外汇任务挂钩的办法。上述任务以经贸部下达的计划和超计划为准,未经经贸部批准的超计划出口,中央不予退税。出口企业要认真编报出口退税计划,主管部门应及时审核汇总上报。
(二)全国年度出口退税计划按国家预算确定的指标执行,并按经贸部批准的超计划出口调整。超过国家预算时,由财政部、经贸部、国家税务局协商报国务院决定。
分季度的出口退税计划由国家税务局与经贸部确定。
(三)国家税务局、经贸部根据国家下达的出口计划、年度总退税指标和税收等有关情况,核定各省、自治区、直辖市和计划单列市及中央外贸(工贸)企业出口退税的年度和季度计划,分别下达各地税务局(直属进出口税收管理处)、经贸委(厅、局)、各外贸(工贸)总公司和中
央金库各分金库执行,并抄送财政部。
(四)各省、自治区、直辖市和计划单列市税务局(直属进出口税收管理处)、经贸委(厅、局)应根据国家税务局、经贸部下达的出口退税计划,共同核定市、县和各出口企业的出口退税计划,并抄送当地财政厅(局)、中央金库各有关分支金库。不承担国家出口计划的企业,原则
上不核定出口退税计划。
(五)各地区和各外贸(工贸)总公司应当努力完成国家下达的出口计划,实行出口退税与国家下达的出口计划挂钩,按季进行考核的办法。凡上季度未完成出口计划的,国家税务局、经贸部将相应扣减其下季度的出口退税计划。各地区、各外贸(工贸)总公司对当地或所属出口企业
如何考核、挂钩,由各地区税务局(直属进出口税收管理处)、经贸委(厅、局)和各外贸(工贸)总公司制定办法,并报国家税务局、经贸部备案。
(六)按企业核定出口退税计划后,主管出口退税的税务机关应在核定的计划内严格按照出口退税的政策规定进行审核并及时办理退税。既不准在企业退税计划未退完的情况下将不该退税的产品予以退税,也不得将该退税的产品不予退税。擅自批准超计划退税的,上级财政、税务部门
应责令其改正,并在财政决算时,从该地区财政收入中扣回。情节严重的,要追究领导者的责任。
(七)地方政府或主管部门在经贸部下达的出口计划和经贸部批准的超计划出口之外,增加出口企业出口任务的,可由当地政府和财政部门酌情对这部分新增出口产品安排一定数额的出口退税计划,由地方财政负担。实行各种财政包括体制的地区,可直接从地方预算收入中退付;实行
总额分成体制的地区,年度中可先从地方预算收入中退付,年终结算时,由中央按分成比例扣回。无论实行何种体制的地区,均不得从中央金库退税。
国家和地方政府批准增加出口退税计划,应及时通知有关税务机关和银行部门,按照上述规定,分别由中央金库和地方金库退付。
(八)中央金库和各分支金库对出口退税计划的执行负有监督责任。各级国库在审查办理退税时,应要求批准机关提供有关文件或退库申请书。凡当地税务机关或出口企业超计划办理退税或违反有关规定退税的,中央金库和各分支金库一律不予退付。
二、严格退税凭证管理,加强出口退税审核
(一)出口企业申请退税,必须提供海关盖有“验讫章”的产品出口报关单、出口销售发票、出口产品购进发票和银行的出口结汇水单。税务机关必须认真按照国家税务局、经贸部、海关总署联合制定的《出口产品退税审批管理办法》(〔89〕国税流字第390号)的有关规定认真
审核无误后,才能办理退税。
(二)申请出口退税的企业,应当具有出口经营权并承担出口创汇任务。工业企业委托具有出口经营权的企业出口自产产品,准予退税。其他没有出口经营权的企业,不予退税。
(三)对企业申报出口的高税率产品(具体品名见《海关对出口退税报关单管理办法》),经海关审核后,将该项产品的出口退税报关单加封后交出口企业带交企业所在地主管出口退税的税务机关拆封登记,然后交出口企业办理退税。
(四)出口企业申请出口产品退税应提供银行出具的结汇水单,并由出口企业每半年提供一次经当地外汇管理部门出具的“已核销”证明(具体办法有关部门另行制定)。
(五)改进对高税率产品和贵重产品的出口退税管理。凡由经贸部批准的外贸公司经营出口的机械手表(包括机芯)、化妆品、橡胶制品、黄金首饰、珠宝玉石、水貂皮、鱼翅、燕窝、鲍鱼、海参、鱼唇、干贝等产品,由当地税务机关审核无误后,报省、自治区、直辖市和计划单列市
税务局(直属进出口税收管理处)审批退税。未批准的企业经营出口的不予退税。
(六)出口退税必须有专门机构管理。各地税务机关尚未按照国家税务局(89)国税流字第260号和国税发〔1990〕083号文件的规定,设立出口退税管理机构的,要报请当地政府和编制部门批准,尽快设立出口退税管理机构,并按照工作需要配备专职人员。凡不按规定设
立出口退税专门机构的地方,不能办理出口退税。各级经贸主管部门要根据本地区出口退税业务量的情况设立出口退税稽核组或专职稽核员,负责监督检查出口企业执行退税规定的情况,出口企业必须将退税申请表和有关凭证先送经贸主管部门稽核员审核签章后,再送主管退税的税务机关
办理退税。否则,税务机关不予受理。
各出口企业必须设专职执办理出口退税的人员。办税员应经税务部门培训并发给结业证书后,方可办理出口退税。办税员要相对稳定,遇特殊情况需要变更办税员时,应事先通知税务部门,并经培训和确认。非专职办税员,一律不得办理退税。
三、严厉查处出口退税违章行为
(一)出口企业有下列违章行为之一的,按《中华人民共和国税收征收管理条例》处理,除令其限期纠正外,处以人民币五千元以下的罚款:
未按规定办理出口企业退税登记的;
未按规定申报出口产品退税鉴定的;
未按规定建立、使用和保存有关出口退税账册、票证的;
拒绝税务机关检查和提供退税资料、凭证的。
(二)由于出口企业过失而造成实际退税款大于应退税款的,税务机关应当令其限期退回多退税款。逾期不退的,从限期期满之日起,依多退税款额按日加收千分之五的占用金。
(三)出口企业虚报出口产品价格和采取伪造、涂改、贿赂或其他非法手段骗取退税的,除令其限期补交所骗税款外,还应处以所骗税款五倍以下罚款。对直接责任人和指使、授意、怂恿骗税行为者,处以人民币一千元以下罚款。情节严重的,提请司法机关追究刑事责任。
对骗取退税情节严重的出口企业,除按上款规定处罚外,可由国家税务局批准停止其半年以上的出口退税权。在停止退税期间出口的产品,不论其是自营出口还是代理出口,一律不予退税和停开“代理出口产品证明”。
出口企业骗取退税数额较大或情节特别严重的,由经贸部撤消其出口经营权。
(四)对为出口企业非法提供或开具假发票或其他假退税凭证的,按其非法所得处以五倍以下罚款。数额较大、情节严重并造成出口企业骗取税款的,应从重处罚或提请司法机关追究刑事责任。
(五)对追回的多退税款和企业骗取的退税,应按照所退税款的科目和级次交入国库。对收取的占用金和罚款,应以“占用税收税款滞纳金、补税罚款收入”科目交入地方金库。
本通知从1991年1月1日起实行。
